Our investigations are confidential, but the Commissioner may issue a public report if the matter is formally investigated and of public interest.
Formal investigations are relatively infrequent, and most complaints are resolved using our informal complaint resolution process. While we do not issue reports on complaints resolved informally, examples of this work can be read in Your Stories and in our annual reports. VinAudit Canada Inc v Government of YukonS.C. No.22-A0065
A judicial review was brought by VinAudit Canada Inc. against the Department, pursuant to s.105 of ATIPPA, with the Information and Privacy Commissioner (IPC) as an intervener. Justice Crerar overturned the decision by the Deputy Minister (DM) of HPW to reject the recommendations of the IPC in report ATP-ADJ-2022-02-045 and ordered the DM to release the requested information. In effect, the Court’s decision affirms the IPC’s findings and recommendations in its report.

This is an application brought by the parties for a determination of two preliminary questions arising in two applications for judicial review under s. 105 of the Access to Information and Protection of Privacy Act, SY 2018, c. 9 (the “Act”) and Rule 54 of the Rules of Court of the Supreme Court of Yukon (“Rules of Court”). For reasons of efficiency, one application was brought to determine these questions in two different and unrelated files. This decision applies to both files.

Duncan in regard to a court case between VinAudit Canada Inc and the Government of Yukon, with the Yukon Information and Privacy Commissioner as an intervener. The preliminary issue before the court was standard of review on a judicial review conducted pursuant to s.105 of ATIPPA.

Some Yukon public schools are collecting, using, and disclosing student images and videos on internet platforms, including social media, as part of their outreach with parents and the community. This audit found that the Department did not have the authority for these actions, nor did they meet their obligations under the Access to Information and Protection of Privacy Act or their own regulation.
